Annual Disclosure Report Still Required
The withdrawal does not end the statutory duty to submit the ADR. The NMC said the requirement continues under Sections 24(i) and 25(h) of the National Medical Commission Act, 2019, and the regulations applicable from time to time.
What the Withdrawal Does Not Affect
The notification protects the following:
- Any action taken, or purported to be taken, under the regulations before their withdrawal
- Approvals, renewals, orders, decisions and directions granted or issued before the date of de-notification
- Rights, privileges, obligations or liabilities acquired, accrued or incurred under the regulations before their withdrawal
Pending and Future Matters
Applications, proceedings, appeals, inquiries and other matters pending immediately before the de-notification will continue to be dealt with under the 2023 regulations, as applicable and subject to the notification’s terms. Matters arising on or after the date of de-notification will be governed by the National Medical Commission Act, 2019, and the statutory and regulatory provisions in force at the relevant time.
Background
The report does not name the withdrawn regulations. Other coverage identifies them as the Maintenance of Standards of Medical Education Regulations, 2023 (MSMER-2023) [VERIFY against the Gazette notification]. Those rules were published on September 19, 2023, and covered annual disclosure reports, evaluation, compliance, and penalties. The report does not say whether replacement regulations are planned or how the earlier penalty provisions are affected.
